Your registration obligations:

If we consider that this obligation has been breached, we reserve the right to block your access to the use of the service, for a fixed or indefinite period, without prior notice.

Price and payment terms:

Prices shown include VAT at the legal rate at the date of purchase, where applicable.

The purchase price shown on the website at the time of purchase is the final sale price

Payment for products is made by credit/debit card when placing the order online.

VISA, VISA ELECTRON, MASTERCARD and MAESTRO cards issued by banks in EU member countries are accepted. This method of payment does not involve any additional fees. At the time of payment, in order to ensure the protection of transactions, confidential data is transmitted directly via the payment processor to the bank using an SSL certificate. The payment information is never stored on ESIM DIGITAL SRL servers, which only store the last 4 digits of the card used to make the payment, in order to make it easier to identify the payment. The bank and the payment processor are the only institutions that come into contact with the payment information, and they offer a full guarantee.

Delivery information:

The delivery of the purchased products/services is carried out in 2 stages. Initially the order is placed, then the payment is processed by the processor and the bank. Immediately after the 2 steps the purchased product/service is available to the user. In case of technical problems or defects, the delivery of the product may be delayed for the time necessary to remedy them.

Product responsibilities

SC ESIM DIGITAL SRL does not assume responsibility and cannot be held liable for any damages arising from the use of products/services purchased through this site for purposes other than those mentioned by the manufacturer. The return of products/services purchased from the website www.esim.ro cannot be made, in accordance with the provisions of OG 130/2000, and for more details please visit the section ” Product return”.

Litigation

By using, viewing or purchasing products/services on this site, the user acknowledges that Romanian law will govern the above Terms and Conditions and any dispute of any kind that may arise between the user and SC ESIM DIGITAL SRL. In the event of any disputes between SC ESIM DIGITAL SRL and its customers, it will first attempt to resolve them amicably within a minimum of 30 working days.

If an amicable settlement is not possible, the conflict will be resolved by the competent court at the headquarters of SC ESIM DIGITAL SRL, in accordance with the Romanian laws in force, regardless of the nationality/citizenship of the customer or the place where he uses the products purchased through esim.ro.

Service-specific rules esim data

ESIM DIGITRAL SRL does not guarantee the speed or coverage area of local mobile networks and does not guarantee connection to any of the 3G, 4G/LTE, 5G, or other protocols. The actual speed provided depends mainly on the network accessed by the user, the product offered being compatible with the protocols mentioned herein, any limitation in use coming from the network provider.

All esim data variants offered through esim.ro are limited in time of use – validity period – and relate to the anticipated allocation of network resources. For this reason all services offered are prepaid, the usage being paid in advance, regardless of whether the customer will access the data within the validity period or not.

The validity period starts on the date of the first connection to the network of a mobile operator in the countries accessible according to the selected product. However, the product loses its validity if more than 3 months pass between the date of purchase of a product and the date of the first connection.

The products offered may have data transfer speed limitations. The limitation will be daily, being constant for every 24 hours. Unused traffic is not carried over. Transfer speed depends on the local network accessed, as the services provided allow connection to 3G, 4G/LTE and 5G protocols.

Services configured with a daily data limit do not allow reporting. Being a prepaid service, not using the data included in the service does not entitle the customer to a refund.

ESIM DIGITAL SRL reserves the right to discontinue the provision of services if they are not used in accordance with the purpose for which they were provided. The following situations are considered cases of violation of the client’s obligations of proper use of the service by ESIM: (i) the product is used in connection with the commission of a crime or acts sanctioned criminally or administratively by the legislation in force (ii) when ESIM DIGITAL SRL has justified suspicions that the data are used improperly or with non-compliance with legal regulations (iii) if the use of the data generates security risks (iv) if ESIM DIGITAL SRL receives a request for discontinuation from the competent authorities or courts of law.

Miscellaneous

If any of the above clauses are found to be void or invalid for any reason, this shall not affect the validity of the remaining clauses. By placing an order, the customer accepts without objection the Conditions and Terms of Use, the value of which is the same as a valid contract.

By agreeing to these Terms and Conditions, the customer fully assumes all rights and obligations arising from the purchase from the online store www.esim.ro.

RETURN POLICY

According to the provisions of Government Ordinance no.130/2000, on consumer protection in the conclusion and execution of distance contracts, certain products and services may be returned by users under the conditions provided by law within 10 working days from:

a) for products, from the date of receipt by the consumer;

b) for services, from the day of conclusion of the contract;

A distance contract is a contract for the supply of goods or services concluded between a trader and a consumer, within the framework of a sales system organised by the trader, using exclusively, before and at the conclusion of this contract, one or more means of distance communication.

The right to renounce the purchase does not apply to legal entities.

According to the provisions of Ordinance No 130/2000, the consumer cannot unilaterally terminate the following types of contracts, unless the parties (consumer and trader) have agreed otherwise:

a) contracts for the supply of services whose performance has begun, with the consumer’s consent, before the expiry of the 10 working days;

b) contracts for the supply of products or services whose price depends on fluctuations in financial market prices which cannot be controlled by the trader;

c) contracts for the supply of products made to the consumer’s specifications or of distinctly customised products, as well as those which, by their nature, cannot be returned or which may degrade or deteriorate rapidly;

d) contracts for the supply of audio or video recordings or software, where such recordings or software have been unsealed by the consumer;

e) contracts for the supply of newspapers, periodicals, magazines;

f) betting or lottery service contracts;

In view of the above provisions, given that the execution of the contract is immediate, upon placing the order, and the product available to the consumer at the same time, PRODUCTS / SERVICES PURCHASED FROM WWW.ESIM.RO WEBSITE ARE NOT SUBJECT TO RETURN POLICY.
